USCIS Blocked from Applying New Public Charge Rule During COVID‐19 Health Crisis 

On July 29, 2020, a federal court blocked the government from applying and implementing the new public charge rules during the COVID-19 national health emergency. The government is barred from applying the new public charge rules to permanent resident applications decided by USCIS in the United States and those that are decided at U.S. consulates and embassies abroad. 

For applications and petitions that USCIS adjudicate on or after July 29th, 2020, USCIS officers will not consider any information provided by an applicant or petitioner that is only related to the evidence required by the Public Charge Rule. This includes information provided on the Form I-944 or any supporting documents, as well as  information on the receipt of public benefits provided on forms I-539, I-539A, I-129 and I-129CW. 

USCIS confirmed that applicants and petitioners whose applications or petitions are postmarked on or after July 29, 2020, should not include the Form I-944 or provide information about the receipt of public benefits.
